With a purchase at dentalshop you accept our general terms and conditions (AGB). These contain all general conditions for trade between Dentalshop and the customer.

1. General/area of application

The following General Terms and Conditions (hereinafter referred to as "GTC") of Dentalshop EURL (hereinafter referred to as "Dentalshop") govern the rights and obligations in the relationship between Dentalshop and its customers with respect to all contracts concluded between the parties exclusively in the online shop.

The deliveries, services and offers of Dentalshop are exclusively based on these GTC. They shall therefore also apply to all future business relationships, even if they are not expressly agreed upon again.

Deviations from these terms and conditions are only effective if confirmed by Dentalshop in writing.

The respective current and binding version of the GTC are published at www.dentalshop.fr In addition, a printed publication can be obtained from Dentalshop upon request.


2. Offer

Dentalshop's offer can be viewed on the website www.dentalshop.fr and is not binding. Dentalshop reserves the right to make changes to prices, product range and technical modifications. All offers are subject to change without notice and are not to be understood as binding offers. All information on www.dentalshop.fr (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) is to be understood as approximate values only and, in particular, does not constitute a warranty of characteristics. All product descriptions, images, photos, text and media data originate from Dentalshop and are subject to Dentalshop's exclusive right of use. Dentalshop assumes no liability for the content of external websites and linked partner shops. Dentalshop's offer is primarily aimed at end consumers. Therefore, Dentalshop reserves the right not to accept orders from customers or to reduce them at its own discretion. Dentalshop also reserves the right to block customer accounts at its own discretion without giving reasons.


3. Conclusion of contract

Dentalshop's offers on the Internet represent a non-binding invitation to the customer to order goods from Dentalshop. On www.dentalshop.fr, the customer submits a legally binding offer to conclude a contract by sending his order and simultaneously accepting these GTC. The order confirmation that is then automatically sent by e-mail documents that the customer's order has been received by Dentalshop, but does not yet constitute acceptance of the offer. After receipt of the order confirmation, orders can no longer be cancelled or changed by the customer. A contract is only concluded upon Dentalshop's declaration of acceptance, which is sent to the customer by e-mail (confirmation of dispatch), or at the latest upon notification of collection. Each order to be delivered is subject to the receipt of payment and availability of the goods at Dentalshop, i.e. the order is placed with the logistics centre/supplier by Dentalshop and the subsequent delivery of the products to the customer is only effected after the payment has been recorded.

If, after the conclusion of the contract, it becomes apparent that the ordered goods cannot be delivered either in part or in whole for reasons for which Dentalshop is not responsible, Dentalshop is entitled to withdraw from the contract in part or in whole.


4. Prices

Unless otherwise stated, the prices quoted on www.dentalshop.fr include statutory value added tax, advance recycling fees (VRG) and copyright levies. The prices are quoted net in € (Euros).

All prices are only valid within EuropeThe date of the order is valid for price fixing. Prices for products and services become binding on both sides at the time of ordering on www.dentalshop.fr in accordance with section 3. When the Internet pages on www.dentalshop.fr are updated, all previous prices and other information about goods become invalid.

Possible shipping costs will be charged additionally and are to be paid by the customer. Shipping costs are shown separately in the order process (see also section 6).

We reserve the right to make technical changes, errors and misprints. Dentalshop may make price changes at any time without prior notice. Consulting and support services are not included in the sales prices.


5. Payment

Orders are payable immediately. Credit cards (Visa, Mastercard, American Express) Paypal and prepayment (online banking, bank or postal transfer, etc.) are accepted as means of payment. The data for payment via credit and debit cards is transmitted in encrypted form.


6. Delivery

The indication of a delivery date is made to the best of our knowledge, but without guarantee. Delivery will only be made after receipt of payment to an account of Dentalshop in case of advance payment or after receipt of an authorisation confirmation in case of credit card payments. Depending on the duration of the payment process, items may therefore no longer be in stock; this does not constitute any liability due to delayed delivery or inability to deliver. From receipt of payment or confirmation of authorisation by the credit card company, the delivery times specified for the product in the online shop begin to run.

The customer will be informed by Dentalshop in the event of delays in delivery. If not all ordered products are in stock, Dentalshop is also entitled to make partial deliveries at its own expense, provided this is reasonable for the customer. In the event of final unavailability of the ordered products, payments made will be refunded. Dentalshop shall not be liable for delivery delays caused by manufacturing companies or third parties.

For orders, a minimum of 4.90 € shipping costs will be charged. For deliveries abroad, other shipping costs apply. Delivery is made directly to the delivery address and contact person provided by the customer.


7. Warranty and service

There is no right of return for articles and products purchased from Dentalshop. An exchange is excluded.

Warranty

Orders are registered. A special warranty certificate is not required. Dentalshop generally requires the return of the defective goods or goods to be replaced.

Further claims are excluded.

The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects that are due to external circumstances. The warranty obligation expires if repairs are carried out by service centres not authorised by Dentalshop.

What to do in the event of damage?

Send a complaint to bonjour@dentalshop.fr and wait for further instructions. When sending in the defective item, it is essential that you enclose proof of purchase (invoice). Our hotline is 03 39 34 00 48.

Any postage costs incurred are to be paid by the customer.


8. Liability

Other claims of the customer, regardless of the legal basis, are excluded, as far as legally permissible. Dentalshop, its auxiliary persons and any vicarious agents shall not be liable for damages that have not occurred to the goods themselves, in particular not for consequential damages, loss of profit or other financial losses of the customer.


9. Damage in transit

If goods are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the carrier/parcel service provider and refuse acceptance, without prejudice to his warranty rights. Hidden defects must be reported to the carrier/parcel service provider (e.g. responsible post office) within 24 hours (1 working day) after receipt of the goods. The customer is obliged to have a damage confirmation report from the parcel delivery company (e.g. postal employee) handed over to him. All transport damage must also be reported to Dentalshop immediately.


10. Retention of title

The ordered goods remain the property of Dentalshop until full payment has been received.

Dentalshop is entitled to make a corresponding entry in the retention of title register. Prior to the transfer of title, pledging, transfer by way of security, processing or transformation is not permitted without the express consent of Dentalshop.


11. Data protection

Dentalshop draws the customer's attention to the fact that the data recorded within the scope of the conclusion of the contract is collected, processed and used to fulfil the obligations arising from the purchase agreement, and may be used for marketing purposes. The data required for the performance of services may also be passed on to commissioned service partners (logistics partners) or other third parties.


12. Changes and additions

Dentalshop expressly reserves the right to adapt or change these General Terms and Conditions of Business to the circumstances at any time and to apply them immediately.


13. Applicable law and place of jurisdiction

In the event of disputes, only substantive Swiss law is applicable, to the exclusion of conflict-of-law provisions. The Vienna Convention on the International Sale of Goods is explicitly excluded. The place of jurisdiction for natural persons is Zurich or the customer's place of residence. For legal entities, Zurich is the exclusive place of jurisdiction.
